The Supreme Court of India has recently expended the horizon of abortion right of unmarried women through historical judgment dated 29.09.2022 in a petition filed by Dr. Rupali’s Medical & Diagnostics and its legal team. Now, any single or unmarried women can terminate/abort her unwanted pregnancy up to 24 weeks without requiring consent of parents, spouse or partner in any registered centre approved by Government.

The Supreme Court held that unmarried women should not be deprived from her fundamental right of abortion as otherwise she will have no other option but to approach the quacks or unqualified person at some unregistered centre and get terminated the pregnancy under unsafe and unhygienic conditions. Unsafe & Illegal Abortions are the true reality of India where unmarried pregnant women go to quacks or unregistered centres for their termination & put their life at risk & complication of uterine rupture, permanent infertility and sometimes death also occur. According to the United Nations Population Fund (UNFPA)’s State of the World Population Report 2022, unsafe abortions are the third leading cause of maternal mortality in India and nearly eight women die from causes related to unsafe abortions every day. Between 2007 and 2011, 67 percent of abortions in India were deemed unsafe. People go to quacks or unregistered place due to lack of awareness of law and high cost of abortions in the hospitals.
